Can I start my activity as a freelancer without registering with the RETA?

Yes, you can register with the Treasury (model 036) as a first step in starting your economic activity, especially if you are in an initial phase with a low volume of turnover. However, keep in mind that, in general, it is also mandatory to register for Social Security (RETA) before starting to bill, even if your income is low.

El trámite que se lleva a cabo en tu Alta en Hacienda, es la obtención del Modelo 036, y es completamente imprescindible para emitir facturas de manera legal.

Es obligatorio disponer de un Modelo 036 para poder acceder a tu cuenta de Selfers.

¿Qué es el alta en el RETA?

Es el trámite mediante el cual una persona se inscribe como autónomo en la Seguridad Social, comenzando así su actividad económica por cuenta propia.Esta misma implica pago mensual de la cuota de autónomos, que varía según tus ingresos. Aquí tienes el sistema de tramos.

Si es la primera vez que tramitas tu alta como autónomo, dispones de una cuota reducida de €87/m. Dependiendo de tu Comunidad Autónoma, podría verse reducida gracias a la subvención de la 'cuota cero' si cumples con los requisitos de la misma.

¿Puedo comenzar mi actividad como autónomo sin darme de alta en el RETA?

Sí, puedes darte de alta en Hacienda (modelo 036) como primer paso para iniciar tu actividad económica, especialmente si estás en una fase inicial con bajo volumen de facturación. Sin embargo, ten en cuenta que, en general, también es obligatorio darse de alta en la Seguridad Social (RETA) antes de comenzar a facturar, incluso si tus ingresos son reducidos.

En la práctica, existen situaciones muy concretas (como actividades esporádicas o con ingresos mínimos) en las que algunos tribunales han considerado que no hay obligación de alta en el RETA.

Aún así, no existe una exención explícita en la normativa, por lo que lo más seguro es tramitar ambas altas desde el inicio. Si no estas seguro, consulta con nuestro equipo y pide tu llamada.

Can I work as a freelancer and as an employee at the same time?

Yes, it is totally legal to combine an employment with an activity as a freelancer. This situation is known as multiactivity, and is increasingly common among potential Selfers who have a permanent job but want to undertake or provide services independently. However, there are some important features:

Multiactivity contribution:

- You will be contributing to Social Security for both schemes (General Regime and RETA). In some cases, you can request a partial refund of contributions if you exceed certain limits.

- Special bonuses: When you sign up for RETA in a situation of multiactivity, you can opt for a reduced contribution base for the first few years. This can be an alternative to the flat rate, although it's not compatible.

Is there a problem if I combine being self-employed and working as a civil servant?

It depends on the type of position you hold as a civil servant. In general, public employees are subject to the regime of incompatibilities established by Law 53/1984, so it is not always possible to carry out an economic activity as a self-employed person while working as a civil servant.

In all cases, compatibility must be requested and expressly authorized by the competent body of your Administration before starting the activity as a freelancer.

Can I register as a self-employed person if I am being unemployed?

Yes, you can do it.

The law makes it possible to make the collection of unemployment benefits compatible with the start of an activity as a self-employed person, or to capitalize on the strike to boost your new business. You have two options:

1. Make unemployment and activity as a self-employed person compatible

You can continue to receive unemployment benefits for up to 270 days (9 months) while you are self-employed, provided that:

- Request it within 15 days from the date of registration with self-employed workers (RETA).
- You didn't start the activity before applying for compatibility.

Important: It is not compatible if you have already used this measure in the previous 24 months or if you are coming from a cessation of activity as a self-employed person.

2. Capitalize on unemployment (single payment)

You can request the advance payment of the outstanding amount of your unemployment benefit for:

- Invest in your activity as a freelancer.
- Cover the cost of Social Security contributions (RETA).
- Or both.

Can I register as a self-employed person if I am taking maternity or paternity leave?

Yes, it is possible to register as a self-employed person while you are collecting a benefit for birth and child care (former maternity/paternity leave), but with important nuances:

If you are an employed worker:

You can register with the Treasury and the RETA, but you cannot start working actively as a freelancer while you are on leave. The law considers that during the leave of absence you are temporarily unable to work, so carrying out an economic activity could be considered incompatible and lead to sanctions or loss of benefit.

If you were already self-employed before the retirement:

You can continue to receive the maternity/paternity benefit as a self-employed person without working, and reactivate your activity once your leave has ended.
Can I register as a self-employed person if I am on sick leave or temporary disability?

Not recommended.

Although the regulations do not expressly prohibit it, registering as a self-employed person while taking sick leave due to temporary disability (IT) can be considered an incompatibility, since the leave implies that you are unable to work.

What risks are there?

Loss of benefit: Social Security can understand that, when you register as a self-employed person, you are fit to work and therefore could lose your temporary disability benefit.

Penalties: In some cases, a file may be opened for possible fraud if it is considered that you are carrying out an economic activity while taking leave.
